The State Great Khural (Parliament) of Mongolia, at its plenary session held on 2 July 2026, officially adopted the Law on Economic Freedom.<\/p>

Alongside the Law on Economic Freedom, Parliament also adopted amendments to the Law on Investment and other related legislation aimed at strengthening Mongolia’s investment framework. These legislative reforms are designed to attract new investment, encourage reinvestment, and enhance the legal protection and guarantees afforded to investors.<\/p>

In addition, Parliament approved amendments to the Law on Permits and related legislation to improve the business environment by reducing the number of permits and regulatory requirements, while enabling certain business activities to be conducted under a notification-based regime rather than requiring prior permits.<\/p>

The amendments to the Law on Investment and the accompanying legislation introduce the following key reforms:<\/p>

Enhanced investment incentives<\/p>

– Expanded tax incentives to promote investment and reinvestment.<\/p>

– Reduced the withholding tax on interest income from eligible loans and debt instruments from 20% to 5%.<\/p>

– Granted 100% customs duty exemption for eligible imported equipment used in construction projects and for data centre and artificial intelligence infrastructure.<\/p>

– Facilitated the establishment of foreign bank branches by exempting them from the 20% shareholding threshold under the Banking Law.<\/p>

– Extended tax incentives for income derived from publicly traded securities, including bonds and shares.<\/p>

Strengthened investor protection and dispute resolution<\/p>

– Established an investor grievance mechanism.<\/p>

– Guaranteed the right to resolve investment disputes through mutually agreed national or international arbitration if disputes cannot be settled through negotiation or mediation.<\/p>

– Designated the Investment and Trade Agency to receive investor complaints and coordinate their resolution with relevant government authorities.<\/p>

Liberalized market access for foreign investors<\/p>

– Ensured national treatment for foreign investors.<\/p>

– Opened additional sectors to foreign investment, including banking, environmental impact assessment, intellectual property services, agricultural commodity exchanges, renewable energy, data centres, and artificial intelligence.<\/p>

Improved investment stabilization framework<\/p>

– Simplified the eligibility criteria for Stabilization Certificates.<\/p>

– Extended the stabilization period to 10\u201320 years for qualifying investment projects implemented for at least five years.<\/p>

Strengthened legal guarantees for investors<\/p>

– Reinforced protections against unlawful interference, suspension, or expropriation of investments.<\/p>

– Enhanced transparency by requiring public consultation and disclosure of decisions affecting investors’ rights and legitimate interests.<\/p>

Improved institutional framework and regulatory efficiency<\/p>

– Clarified the responsibilities of government institutions in investment promotion and protection.<\/p>

– Assigned the Investment and Trade Agency expanded responsibilities for investment facilitation, promotion, investor services, statistics, and grievance handling.<\/p>
